Shhhh, We Can't Tell You is a provider of Internet services including; Hosting, E-mail, Advertising, Design, and Consulting. Shhhh, We Can't Tell You also provides information and consulting related to best practices for privacy and security both online and off. Additionally we partner with Cognigen to provide telecommunications, consumer products, travel, and Internet access services. The following agreement applies to the terms under which Shhhh, We Can't Tell You (SWCTY) and our End-User (YOU) will get along.

Shhhh, We Can't Tell You; SWCTY; SWCTY.net; SWCTY.com; WE; may be used interchangeably to represent Wayne Beach dba Shhhh, We Can't Tell You in the city of Santee, state of California, country of the United States of America and ultimately all known and inhabited parts of our universe.
User; End-User; Customer; Client; YOU; may be used interchangeably to represent you, the person reading this document right now, and / or the company, affiliation, group, sect, organization, disorganization, or conglomerate of living beings you are authorized to represent when entering into any legal agreement.
COPYRIGHT
As of the time of ORIGINAL PUBLICATION, which in most cases is January 1996, all text, graphics, code, formatting, color-schemes, misspellings or anything else on this website that is not otherwise credited is property of SWCTY. No portion of this site may be reproduced, copied, duplicated, imaged, archived, or otherwise published except through the normal medium of the World-Wide-Web wherein each END USER may download one copy to his/her computer for one-time use, unless written permission is issued by SWCTY.

The following content is restricted, and may result in account suspension if specific terms are not adhered to, each item below links to the appropriate restrictions;
You further acknowledge that you will NOT, under any circumstance, use SWCTY for any purpose which compromises the reasonable security of any computer and / or network, nor may you leverage any attack, denial of service, or load test from our service. Compromises of security include but are not limited to; creation or execution of viruses, worms, or Trojans; intentional misuse of trace-route, PING, DNS, rDNS, raw, or reverse engineering of the server software. Our systems are designed to block such attempts and will log and report them to us immediately.
You may NOT host IRC, ircbots, eggdrop-bots, shell, telnet, or similar programs on SWCTY controlled servers. Shell access is available only to the tier one provider SWCTY purchases server space and bandwidth from, "data 393".
You may not use SWCTY to "mail-bomb" or as an address for "mail bombing". For the purpose of this statement, "mail-bomb" refers to the practice of sending bulk unsolicited mail with the intent of overloading a server by either creating error messages or actually consuming that servers bandwidth. Engaging in this activity will result in the originating IP being traced and the offending account being disabled, reported to law enforcement, and/or reported to the ISP of the offender.
PRIVACY
SWCTY values your personal privacy unconditionally. It is because of this that we do not gather information from you or visitors to your site except for the specific situations and reasons denoted below;
SWCTY must comply with any legally initiated request from a law enforcement agency. For SWCTY to consider a request for information to be legally initiated, a valid court-order, subpoena, or warrant must be issued particularly describing the information to be gathered and where that information is to be found (Ammendment IV US Constitution). SWCTY supports and upholds the Constitution of the United States of America above any other code, law or proceedure in all legal matters. SWCTY reserves the right, upon presentation of satisfactory legal documents, to disclose information to law enforcement and judiciary officials without notification to the client.
SWCTY will not allow, for any reason, the monitoring of e-mail communication on our servers without the consent of the account holder to be monitored. If, however, we are presented with evidence that an account is involved in any compromise of public safety or the security and well being of any nation on planet Earth, we reserve the right to disable such account and destroy any information stored within it. The United States may require SWCTY to release the contents of an e-mail account to authorities at any time by presenting a valid court-order, subpoena, or warrant must be issued particularly describing the information to be gathered and where that information is to be found (Ammendment IV US Constitution).

Your name will NOT be published, and will be used ONLY by SWCTY to contact you for billing, or technical notices unless otherwise requested by you, the client.
4. A Valid billing method approved by SWCTY
SWCTY accepts CASH, PAYPAL, PERSONAL CHECKS, BUSINESS CHECKS, and MONEY ORDERS. Payment by check may result in a delay while the check is processed for approval.
SWCTY NO LONGER ACCEPTS E-GOLD AND WILL NOT DO BUSINESS WITH E-GOLD. SWCTY ENCOURAGES E-GOLD HOLDERS TO CASH OUT THIER ACCOUNTS AND WHEREVER POSSIBLE TAKE PHYSICAL DELIVERY OF THEIR "GOLD" HELD BY E-GOLD, AND TO MAKE TRANSACTIONS ONLY WITH REAL CURRENCY ISSUED ON A NATIONAL TRUST.

AUDIO & VIDEO FILE RESTRICTIONS
YOU MUST BE THE COPYRIGHT OWNER OR BE AUTHORIZED BY THE COPYRIGHT OWNER FOR ANY AUDIO OR VIDEO CONTENT USED ON YOUR WEBSITE. Shhhh, We Can't Tell You MUST BE NAMED AS AN AUTHORIZED CONTENT PROVIDER ON YOUR USER LICENSE, AND WE MUST RETAIN A SIGNED COPY OF THE LICENSE. SWCTY WILL PROVIDE INFORMATION ABOUT AUDIO & VIDEO HOSTS ON REQUEST TO ANY AUTHORITY REPRESENTING THE COPYRIGHT HOLDER OF SUCH MATERIAL.
ENCRYPTION SOFTWARE RESTRICTIONS
IN THE INTEREST OF INTERNATIONAL SECURITY, PROVIDERS OF ENCRYPTION SOFTWARE MUST STATE CLEARLY THAT THE SOFTWARE IS PROVIDED FOR THE PURPOSE OF ENCRYPTION. PROVIDERS MUST ALSO KNOW AND ABIDE BY ALL EXPORT AND DISTRIBUTION RESTRICTIONS THAT APPLY TO ENCRYPTION SOFTWARE. SWCTY WILL ENFORCE UNITED STATES EXPORT REGULATIONS IN RELATION TO ENCRYPTION SOFTWARE.
SWCTY ALSO REQUIRES THAT ENCRYPTION SOFTWARE PROVIDERS PUBLISH A VALID PGP SIGNATURE USING A FULL LICENSED COPY OF “PGP FOR COMMERCIAL USE” ON THE WEBSITE WHERE THE ENCRYPTION SOFTWARE IS BEING PROVIDED.
COMMERCIAL SOFTWARE RESTRICTIONS
ONLY ORIGINAL CREATORS OR CURRENT COPYRIGHT HOLDERS OF COMMERCIAL SOFTWARE MAY MAKE SUCH SOFTWARE AVAILABLE FOR DOWNLOAD. Shhhh, We Can't Tell You MUST BE NAMED AS AN AUTHORIZED CONTENT PROVIDER ON YOUR USER LICENSE, AND WE MUST RETAIN A SIGNED COPY OF THE LICENSE.
